1. Acceptance of Terms
By accessing or using ptc.guru, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
ptc.guru provides a platform for licensed insurance agents to create, manage, and store Permission to Contact (PTC) forms for ACA health insurance plans. Our service includes e-signature capabilities, PDF generation, and secure long-term storage.
3. User Responsibilities
Users are responsible for ensuring their use of ptc.guru complies with all applicable laws and regulations, including but not limited to CMS requirements for Permission to Contact forms. Users must:
- Provide accurate information when creating PTC forms
- Obtain proper consent from clients before submitting forms
- Maintain the confidentiality of any access credentials
- Use the service only for its intended purpose
4. Payment and Billing
ptc.guru charges $1 per form or offers bulk credit packages as described on our pricing page. All payments are non-refundable. Credits do not expire and can be used at any time.
5. Data Retention and Security
We store all submitted PTC forms securely for 10 years from the date of submission. Each document is timestamped and hashed to ensure its integrity. We implement industry-standard security measures to protect your data.
6. Limitation of Liability
ptc.guru is provided "as is" without warranties of any kind. We are not responsible for any damages arising from your use of our service. Our liability is limited to the amount paid for the service.
7. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of ptc.guru after changes constitutes acceptance of the new terms.
8. Governing Law and Jurisdiction
This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Exclusive venue for any disputes arising out of or relating to these Terms shall be the state and federal courts located in Travis County, Texas.
9. Dispute Resolution and Arbitration
Any dispute arising from or relating to these Terms or the use of ptc.guru shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, any controversy or claim shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Travis County, Texas, and be conducted in English. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
10. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
11. Entire Agreement
These Terms constitute the entire agreement between you and ptc.guru regarding the use of the service, superseding any prior agreements between you and ptc.guru (including, but not limited to, any prior versions of the Terms).
